GENERAL TERMS AND CONDITIONS OF PURCHASE

ACCEPTANCE OF THE TERMS AND CONDITIONS
These general terms and conditions of purchase (the “General Terms and Conditions”) govern the sale by LUJART 2021, S.L., with registered office at C/ Claudio Coello, 90, 28006 Madrid, Spain, and Tax Identification Number B05488366 (hereinafter, MICUIR), to the Customer (the “Customer” or “User”) of the products offered by MICUIR through its online store https://micuir.com/ (hereinafter, “the Website”) in accordance with the provisions of its product catalog.

For the purposes of these General Terms and Conditions, the products are intended exclusively for the Customer or User (understood as any individual over eighteen (18) years of age or a duly represented legal entity) acting as the consumer or end user. Any professional activity involving the resale or distribution of the purchased products is prohibited.

These General Terms and Conditions apply to each and every purchase made by the User through the Website (https://micuir.com/). The user acknowledges having the legal capacity to enter into this agreement and purchase the products, and agrees to be bound by these General Terms and Conditions.

These General Terms and Conditions are supplemented by any applicable Special Terms and Conditions, and the user is also bound by the Website's Terms of Use and Privacy Policy.

PURCHASE PROCESS: ORDER AND ACCEPTANCE
Users (registered or acting as Guests on the Website) can place an order through https://micuir.com/. Users who order a product through the Website declare that they have full legal capacity to enter into contracts and use any of the payment methods offered.

To purchase a specific product, the user must select the desired product, indicate the number of units, and add it to their shopping cart.

Once the product is added to the cart, and if a discount coupon is available, the user can enter the code and update their cart to see the final price.
Similarly, on the right side of the screen, the user will see an estimated shipping cost for their order. The initial shipping estimate displayed at this stage of the purchase process will always be for delivery to Madrid. However, in the next stage, these costs will be updated based on the delivery address.
At this stage, users with a Gift Card can also enter its code to complete their purchase.
Next, the user must click the "Complete Purchase" button. This will open a new stage of the process where the user will be asked to provide the necessary information to finalize the shipment and determine the invoice details that Micuir will issue. The user must complete the shipping form, providing the following personal information (fields marked with an asterisk are mandatory): first name*, last name*, company name (optional), country*, street address*, house number and street name, apartment, room, building, etc. (Optional) Postal code*, city/town*, province*, phone number*, and email address*.

At that point, the user will also have the option to create an account so that on future visits, they can be identified by entering their password without having to re-enter all the shipping information, thus simplifying the purchase process.

Creating an account will require the user to enter a password.
The password is for personal use only and is non-transferable; its assignment, even temporarily, to third parties is prohibited. The user agrees to use the password diligently and keep it secret, changing it immediately upon becoming aware of or suspecting any misuse. The user assumes full responsibility for any consequences that may arise from disclosing the password to third parties.

The user also agrees not to use false identities or impersonate others when using the website, including the use of third-party passwords or access codes, or any other means.

At this stage, the user will also have the option to add a shipping address different from the primary address (which will be the billing address) and to add a special delivery note (clarifications or specific requests). Once this information is entered, the total shipping costs to the address provided by the User will appear on the right side of the screen, separate from the price, before confirming the order. The user agrees to provide a delivery address that allows for delivery during normal business hours. If the user fails to comply with this obligation, MICUIR will not be liable for any delay or inability to deliver the order.

The user will have the option to request in-store pickup by checking the box provided for this purpose. In this case, MICUIR will reserve the product for one week from the date of the online purchase. If the product is not picked up within this period, MICUIR reserves the right to cancel the purchase and issue a refund.

The user will validate the order once they have made the corresponding payment, as established in section four of these terms and conditions. Order validation by the customer expressly implies knowledge and acceptance of these general terms and conditions as part of the contract, which must be expressly accepted by checking the corresponding box before placing the order.
MICUIR will archive a copy of the transactions carried out with users through an electronic document which, unless proven otherwise, will constitute proof of the effective execution of said contract.
Once the purchase has been made and validated, and within a maximum of ten (10) business days from the date of the purchase, MICUIR will send the purchase receipt via email.
Order confirmation does not imply final acceptance: each order is subject to product availability verification procedures. Following these procedures, MICUIR will have a maximum of ten (10) business days from the date the order is placed to inform the Customer of its final acceptance. In the event that a product is unavailable, MICUIR may offer the option to reserve it or place a pre-order (informing the user of the estimated delivery time) or reject the order due to lack of availability.
Once the sales process is complete, MICUIR will provide the Customer with confirmation of the purchase and the accepted terms and conditions applicable to said purchase, thus formalizing the contract between the parties. This confirmation will be sent via email and will include the applicable terms and conditions as attachments.

PRODUCT CATALOG: FEATURES AND AVAILABILITY.

The product supplied by MICUIR will correspond to the descriptions and specifications contained on the website at the time the order is placed. Each product will have a page on the website that includes a brief description, the price, and indicative information about product availability.

The products offered on the website are valid as long as they remain visible and the stock levels indicated for each product are met. Each product will display the estimated delivery time from the warehouse or indicate if the product is out of stock. These delivery times are calculated in business days.

In the event of product unavailability after an order has been placed, the user will be informed by email of: a) the new delivery date if the product needs to be replaced due to damage or defects; b) the cancellation of the order if it cannot be delivered under any circumstances, in which case any payments received will be refunded.

PRODUCT DELIVERY
Products will be shipped via courier to the delivery address indicated in the order within 24 to 72 hours (48-72 hours) from the time the order is placed, Monday through Friday, from 10:00 AM to 2:00 PM. Orders placed outside of these hours will be processed on the next business day.
Products will not be delivered to P.O. boxes or public places.
The user will receive an email from eshop@micuir.com specifying the expected delivery date. In any case, it is important that the user has provided their contact phone number in case the courier company needs to contact them at any time.

Estimated delivery times are as follows:
Spain – 48 to 72 business hours
Europe – 10 business days
Rest of the world – 30 business days

During promotional periods and Christmas, delivery times may be longer.

IMPORTANT: Pre-ordered items will arrive within the date range specified in the item description.

The product will be delivered to the customer as indicated, and the customer must sign the delivery note upon receipt.
If an order is placed for multiple items with different availability, MICUIR will split the order, shipping the available items and sending the unavailable items in a second shipment. In this case, the second shipment will be made at no additional cost.
It is the customer's responsibility to check the status of their order upon delivery and to make any necessary claims at that time. You also have the option to refuse the package if it has been opened or shows obvious signs of damage.

If you notice any problems upon delivery of your order (damaged packaging, missing or damaged products), you must indicate this in writing on the carrier's delivery note and contact our customer service center at ac@micuir.com within three (3) calendar days of receiving the order. The email subject line should read "Product Return Due to Delivery Damage" followed by your order number. No returns of damaged items or claims for missing items will be accepted if the issue has not been reported within the specified timeframe and according to the established procedure.
The product will be considered delivered to the customer's satisfaction when they take possession of it. Upon delivery, the Customer will examine the product, verifying its quantity, condition, and integrity to their satisfaction, and accepting it by signing the corresponding delivery note, which will constitute their express waiver of any subsequent claim.

RIGHT OF WITHDRAWAL
MICUIR recognizes the Customer's right of withdrawal, who may return the product within a maximum period of fourteen (14) calendar days from the date of physical receipt of the product.
The right of withdrawal may be exercised by sending a written communication via email to ac@micuir.com with the subject line: “Product Return due to Withdrawal” followed by the order number.

Requests not made through the indicated procedure will not be processed.

The refund will include the full purchase price. The refund will be issued via the same payment method used for the original purchase. MICUIR informs Customers that the direct costs of the return will be borne by the requesting Customer.

The Customer shall return the products subject to withdrawal without undue delay, within a maximum period of fourteen (14) calendar days from the date on which they notify MICUIR of their decision to withdraw. The refund of the amount corresponding to the withdrawal will be made within fourteen (14) calendar days from the date on which the decision to withdraw from the contract has been effectively and unequivocally communicated, provided that MICUIR has previously received the product. Otherwise, the refund may be withheld until the product is received or until the Customer provides proof of its return.

In any case, for the purposes of exercising the right of withdrawal, it is necessary that the product be returned in its original packaging along with the invoice. Before returning the product, the Customer must ensure that it is properly protected and sealed to prevent any damage during transport.
MICUIR will provide the Customer with a sample withdrawal form.

EXCHANGES AND RETURNS
EXCHANGES: The customer may request an exchange for a different size or model within 15 days of receiving the product.
